The fact that he personally never went to the Capitol leaves you with too indirect a line of action. Of course if the SS had been willing to take him to Capitol the case is probably a slam dunk - but then again if they had we might be in the middle of a civil war. He was not at the Capital Riot. He organized a key part of it. As did Trump. Quote

He's already charged with plenty to put him away.
